We do not warrant that our services will meet your specific requirements, be uninterrupted, timely, secure, or error-free, or that any defects will be corrected.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PGD GROUP LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of or inability to access or use our services
• Any conduct or content of any third party on our services
• Any content obtained from our services
• Unauthorized access, use, or alteration of your transmissions or content

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

You agree to defend, indemnify, and hold harmless PGD Group LLC and its officers, directors, employees, contractors, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms
• Your use of our services
• Your violation of any rights of another party
• Your violation of any applicable laws or regulations

Term and Termination

Term

These Terms remain in full force and effect while you use our services.

Termination by You

You may terminate your account at any time by contacting us or using the account termination features available in our services.

Termination by Us

We reserve the right to suspend or terminate your access to our services at any time, with or without cause, with or without notice, effective immediately. Grounds for termination may include, but are not limited to:

Effect of Termination

Jurisdiction and Venue

You agree that any legal action or proceeding arising out of or relating to these Terms or our services shall be brought exclusively in the federal or state courts located in Connecticut, and you consent to the personal jurisdiction of such courts.
